1. The agreement
These terms are an agreement between you and the provider of Highseat at highseat.com:
- Legal name: Piotr Kulpiński
- Address: Al. Pokoju 83A/12, 31-564 Kraków, Poland
- Tax number (NIP): 8661673036 (EU VAT number PL8661673036)
- Registry entry: Central Register and Information on Economic Activity (CEIDG), REGON 260591531
- Email, for privacy and anything else: support@highseat.com
You accept them when you create an account. If you use Highseat for a company, you accept them for that company and confirm you may do so. The privacy policy explains how we handle personal data. The data processing agreement is part of these terms and applies to the data your sites collect.
2. Accounts and workspaces
An account belongs to one person. A workspace holds sites, members, API keys and billing. Each workspace has at least one owner, who is responsible for its plan. Owners and admins manage the workspace; viewers can read reports.
Keep your sign-in details safe, and tell us at once if you think someone else has used your account.
3. The trial
A new workspace gets a 14-day trial with every feature and no card required. One person gets one trial: a person whose earlier trial ended without a payment cannot start another by creating a new workspace.
If you choose a plan during the trial, the first charge happens when the trial ends. In the last 3 days of the trial we email the owners. A trial that ends without a plan lapses, as described under When a plan or trial ends.
4. Plans, prices and payment
A plan is a monthly allowance of events. Every plan has the same features. Prices are listed in the price list, in US dollars. You pay monthly or yearly, in advance. A yearly plan costs ten months.
Stripe processes every payment. We ask for a billing address and, for a business, a VAT number before the first payment, so the invoice is correct.
Prices are net of VAT. A business in the EU outside Poland with a valid VAT number pays the price as listed, and accounts for VAT itself under the reverse charge. A customer in Poland, and a consumer anywhere in the EU, pays VAT on top, at the rate the law sets for them.
Stripe sends the payment receipts, and the emails about failed payments, expiring cards and renewals. We send the emails about the trial, usage and deletion.
If a renewal fails, Stripe retries it for 14 days. Everything keeps working during those days. If the payment still fails, the plan ends and the workspace lapses.
You can change or cancel your plan at any time on the workspace's Billing page. A cancelled plan runs to the end of the period you paid for. We do not refund a period already started, monthly or yearly. A consumer keeps the right to withdraw described below.
We may change prices. A change applies from your next renewal, and we email the owners at least 30 days before it does.
5. What counts, and going over
One event is one page view or one custom event. The properties sent with it never multiply it. Engagement pings, identify() calls, payment records, imported history, bots and excluded traffic never count.
We never drop an event for being over the plan. A billing period counts as over when it uses more than 110% of the plan's allowance. When two periods in a row are over, we email the owners, and the dashboards lock 7 days after the second period passed 110%. Collection continues while they are locked. The lock lifts when you move to a plan that covers your usage, or when a period ends at or under 110%.
6. When a plan or trial ends
A workspace lapses when its trial ends without a plan, when a renewal still fails after Stripe's retries, or when a cancelled plan reaches the end of its paid period. Every cause follows the same clock.

| Day | Collection | What changes |
|---|---|---|
| Day 0 | Continues | Dashboards, the API, share links, invitations and new sites lock for every member. Owners and admins can still export. |
| Day 14 | Stops | The tracker keeps loading, but no new event is stored. Export stays open to owners and admins. |
| Day 53 | Stopped | The owners get one deletion notice by email, with a link to export each site. |
| Day 60 | Stopped | The sites and every event they recorded are deleted. The workspace, its members and its invoices stay. |
Deletion never happens sooner than 7 days after a mail server accepted the deletion notice, so a notice that bounced pushes the date back. Choosing a plan before deletion restores everything, including the events collected during the first 14 days.
Collecting for those days is part of the service and ends on a fixed day, so the data stays under your instructions. Deleting the sites on day 60 is your standing instruction to us under the data processing agreement.
A workspace that never had a trial or a plan collects nothing until it pays.
7. Your data
The data your sites collect is yours. We use it only to provide the service to you, as the data processing agreement sets out.
Owners and admins can export every event of a site as a CSV file, free and in every state of the workspace, until the site is deleted. An export file can be downloaded for 7 days, then it is deleted.
You are responsible for what your sites collect: for telling your visitors about it in your own privacy notice, and for asking their consent where your law requires it. Do not send us special categories of personal data, and do not put an email address or another direct identifier in identify(), an event property or a URL.
8. Acceptable use
Track only sites you own or are allowed to track. Do not use the service to break the law, to collect data you have no right to, to send fake or automated traffic to inflate figures, or to overload or probe the service. Do not resell access to it without our written agreement.
We may suspend a workspace that breaks these rules or puts the service or other customers at risk. We tell the owners why, unless the law or an ongoing investigation prevents it.
9. The service
We work to keep the service available and your data safe, and we improve it over time. We may change or remove a feature. If a change takes away something you rely on, we tell you before it happens.
We do not guarantee a level of uptime, and we offer no service credits for downtime.
10. Liability
The service is provided as it is. Neither side is liable for indirect or consequential loss, such as lost profit or lost data that an export would have saved.
Our total liability in any 12 months is limited to the fees you paid us in those 12 months. This limit does not apply to harm caused on purpose, to a consumer's rights, or to any other liability that the law does not allow to be limited.
11. If you are a consumer
If you buy as a consumer, or as a Polish sole trader buying outside your profession, you keep every right consumer law gives you. That includes the right to withdraw from the contract within 14 days of concluding it, without giving a reason.
To withdraw, write to support@highseat.com within those 14 days saying you withdraw from the contract. We confirm the withdrawal by email and refund the payment within 14 days, by the method you paid with.
If you asked for the paid plan to start during the 14 days, you pay for the days you used it before you withdrew, in proportion to the price. The free trial costs nothing, so a withdrawal during the trial costs nothing either.
12. Ending the agreement
You can stop at any time: cancel the plan, delete the workspace, or delete your account in the dashboard. Deleting is final.
We can end the agreement for a serious or repeated breach of these terms, after telling you. If we stop offering the service altogether, we tell every workspace owner at least 90 days before, so there is time to export, and we refund the unused part of any prepaid period.
13. Changes to these terms
We may update these terms. We email the owners of every workspace at least 30 days before a change that affects them takes effect. If you keep using the service after that, the new terms apply. If you do not agree, you can cancel before they take effect.
14. Law and disputes
Governing law: Polish law. Courts: the common court with jurisdiction over the provider's place of business in Kraków. A consumer keeps the protection of the law of the country where they live, and may go to their own courts.
